class=\"wp-block-coblocks-accordion-item__content\"><p>Version 2.7 valid from 04.01.2026<\/p><h5>1. Purpose \/ Scope of application<\/h5><p>Parcandi is an application (hereinafter &#8220;App&#8221;) that can be used to rent parking spaces (including any additional services) from owners in certain properties in Switzerland. Parcandi AG (hereinafter &#8220;Parcandi&#8221;) acts solely as an intermediary for the car parks.<\/p><p>The actual tenancy is concluded directly between the owner of the respective property or the responsible property management company, both represented by Parcandi, and the user of the app.<\/p><p>The owner rents the car park to the tenant under the conditions set out in the app (in particular the agreed net rent, the ancillary costs due and the permitted use). The tenant declares that he is aware of the condition of the rented property and does not require any further explanations. He accepts the rental property in its current condition and undertakes to use it exclusively for the agreed purpose.<\/p><p>These General Terms and Conditions (hereinafter referred to as GTC) are an integral part of the rental agreement. The use of the app and the booking of a car park requires agreement to these.<\/p><h5>2. Utilisation regulations<\/h5><p>The rental property is intended for the parking of a motor vehicle, to the exclusion of any other use. Due to the structural conditions of the rental property, use is only permitted with the vehicle type selected in the booking process and for vehicles within the permitted height of the car park. Use of a parking space is permitted only within the booked vehicle category. Use of a higher-value or different category space (e.g., using a car space when a motorcycle space was booked) is not permitted. Use of the service without a prior booking via the app is not permitted.<\/p><p>Vehicles may only be parked within the parking spaces reserved by the user and designated by Parcandi within the marking. Use of the covered parking space is permitted for one vehicle only per booking or rental agreement. Use is only permitted during the times defined in the rental agreement or for each building (e.g. from 19:30 to 7:30). The parking lots must be vacated immediately at the end of the rental period. Vehicles parked illegally or in such a way as to obstruct traffic may be moved, towed away or blocked for a fee.<\/p><p>The user shall insure the vehicles and their accessories located in the car park used at his own expense against fire, explosion, water and vandalism or burglary damage at their value. Neither Parcandi nor the owner shall be liable for damage to the parked vehicles and the user alone shall also bear the consequences of any failure to fulfil this insurance obligation, to the full discharge of Parcandi or the respective car park owner.<\/p><p>It is prohibited for the vehicle owner and\/or third parties to linger in the car parks or on the parking spaces or plots when accompanied by the vehicle owner and\/or third parties, or to use the parking spaces and facilities for any other purpose, e.g:<\/p><ul><li>Storage of goods, fuels and other flammable or explosive materials,<\/li><li>Repairing or washing cars, causing soiling<\/li><li>Driving with play and sports equipment<\/li><li>Consumption of drinks or food<\/li><li>Causing unnecessary noise (e.g. by running engines, playing music, slamming doors, etc.).<\/li><li>Distributing advertising materials and putting up posters in car parks or on the premises<\/li><li>Smoking in the car parks or on the premises<\/li><li>Use of the car park with more than one vehicle<\/li><li>Charging electric vehicles without a corresponding contract in accordance with section 4.4<\/li><\/ul><p>The instructions of Parcandi or the owner of the respective property or its management must be followed.<\/p><p>By reserving or booking a parking space or additional services, the tenant accepts the house rules applicable to the car park, the terms and conditions of use for the car park and Parcandi&#8217;s GTC. In the event of a conflict between the GTC and the house rules, these GTC and the terms and conditions of use of the Parcandi car park shall take precedence.<\/p><p>The use of a car park may be restricted for residential purposes. It is then labelled in the app as &#8220;Reserved for residents and for residential use only&#8221;. The service offered in these car parks is only reserved for residents and for residential destinations that are within a reasonable distance of the allocated parking space. The user undertakes to use the car park and to ensure that the main residence to which the space is allocated is located in the immediate vicinity (approx. 200m, or in accordance with the cantonal ordinances and jurisdiction applicable to the car park in question).<\/p><p>If the user changes the use of the rental property or part of it without authorisation, Parcandi or the owner may terminate the rental agreement extraordinarily or even without notice.<\/p><p>Full or partial subletting of the rental property (Art. 262 CO) is not permitted.<\/p><p>Parcandi and\/or the owner of the property have the right to take and store recordings of users&#8217; licence plate numbers in accordance with the applicable data protection regulations (see <a href=\"https:\/\/cembrapay.ch\/de\/privacy\" target=\"_blank\" rel=\"noopener\">Privacy Policy<\/a>).<\/p><p>Accidents involving personal injury must be reported to the police. In the event of accidents involving other vehicles (damaged property), the personal details of the user and their insurance details must be deposited with the damaged vehicle.<\/p><p>Damage and defects in the car parks or on the premises and their facilities (barriers, cash desks, lifts, lighting, signals, etc.) must be reported to Parcandi or the responsible administration.<\/p><p>The car park must be left in a clean and completely cleared condition at the end of use. Any clearing and\/or cleaning costs will be charged to the user\/tenant.<\/p><p>Parcandi has the right to block the use of the app at any time.<\/p><p>Parcandi or the respective owner or its management of the car park shall be entitled to charge the perpetrators for any expenses incurred as a result of non-compliance with these regulations.<\/p><p class=\"p1\">Parcandi reserves the right to pass on to the breaching user any and all damages incurred as a result of the violation. For each violation, an administrative fee of at least CHF 20 will be charged.<\/p><p class=\"p1\">Parcandi further reserves the right to assert additional claims for damages exceeding the minimum administrative fee, covering the actual costs or losses incurred. Any further claims for damages remain expressly reserved.<\/p><p>The right to claim further damages is reserved. Repeated non-compliance will result in the user being permanently blocked and any existing rental agreements being cancelled.<\/p><h5>3. Reserve and book<\/h5><p>3.1 Short-term parking<\/p><p>The user makes a reservation request for an undefined period for the desired parking space and the desired additional services. The reservation request does not entitle the user to a parking space or the selected additional services.<\/p><p>If a parking space is available at the desired time and the selected additional services are available, the user receives a reservation confirmation for a specific parking space for the required period and the additional services.<\/p><p>If the rental confirmation refers to a fixed parking space with a parking space number, this is binding. Parking is only permitted during the times of use of a car park defined in the rental agreement or for each car park (e.g. between 19:00 and 6:00 the following day).<\/p><p>Parcandi can offer automatic licence plate recognition. In this case, the rental agreement is started when the licence plate number is recorded on entry and ended when it is recorded on exit. The payment process must be carried out by the user.<\/p><p>The user owes the fees due for the rental period and the corresponding model and for the additional services used.<\/p><p>To terminate the rental relationship, the user must end the booking in the app after leaving the car park or when he no longer needs the car park. The user owes the tariff due for the rental period, as well as the fees owed for the additional services used, which will be charged to the user accordingly.<\/p><p>3.2 Long-term parking<\/p><p>The user submits a rental request for a parking space and the desired additional services for an indefinite period of time. Depending on the selected subscription, use may be restricted to agreed times (e.g. Monday to Friday, from 7.30 am to 6.30 pm). The user is not entitled to a parking space or the selected additional services with the rental request.<\/p><p>The allocation of a fixed parking space is possible by agreement.<\/p><p>If a car park is available according to the request and the selected additional services are available, the user will receive a rental confirmation for a specific car park and the selected additional services.<\/p><p>If the rental confirmation refers to a fixed car park with a car park number or to defined times (e.g. between Monday and Friday, between 8:00 and 18:00), these are binding. Parking outside the agreed times is not permitted.<\/p><p>The licence plate number must be stored in the application to gain access to the car park. Several licence plates can be stored for one user. However, only one vehicle per rented parking space may be in the car park.<\/p><p>To terminate the tenancy, the tenant cancels the subscription in the app or informs Parcandi (+41 (0) 61 512 45 05, kundenservice@parcandi.ch). Parcandi will inform the tenant in the intended manner.<\/p><p>The user owes the fees due for the rental period and the corresponding model and for the additional services used.<\/p><p>The conditions differ depending on whether the car park is rented separately or in connection with residential or business premises:<\/p><p>Separately rented car park:<\/p><ul><li>As part of the rental enquiry, the user confirms to Parcandi that no other personal tenancy (residential or business premises) exists in the property of the object.<\/li><li>The tenancy agreement is concluded for an indefinite period. Parcandi and the tenant may terminate the tenancy with a notice period of two weeks at the end of each month.<\/li><\/ul><p>Car park with simultaneously available, personally rented residential or commercial space<\/p><ul><li>As part of the rental enquiry, the user confirms to Parcandi that a further personal tenancy (residential or business premises) exists in the property of the object.<\/li><li>The owner is obliged to hand over the rented property at the agreed time in a condition that is suitable for the agreed purpose.<\/li><li>The user can terminate the rental relationship for the car park rented via Parcandi with a notice period of two weeks at the end of each month.<\/li><li>The notice period on the part of Parcandi or the owner is governed by the provisions of the existing, separate residential or commercial tenancy agreement.<\/li><li>The ordinary or extraordinary termination of the rental agreement for the flat or business premises rented separately by the user automatically leads to the termination of the rental agreement for the car park rented via Parcandi under the same conditions. This also applies in the event of early cancellation.<\/li><li>If the user does not notify Parcandi or the owner in writing (by letter or e-mail) of any defects within 14 days of the start of use, Parcandi or the owner can assume that the rental property has been handed over in a condition that complies with the rental agreement.<\/li><\/ul><p>3.3 Additional services<\/p><p>Additional services are only offered at defined locations. There is no entitlement to the offer of additional services by Parcandi and\/or the landlord\/owner. The rate applicable to the booking of the additional service is displayed during the reservation enquiry. By making the enquiry, the user accepts the underlying tariff.<\/p><p>These additional services are currently available:<\/p><ul><li>Provision of infrastructure for drawing charging current. With the rental confirmation, Parcandi or the owner undertakes to provide a tested and functional charging station. The user is obliged to use the charging station in accordance with its purpose and technical characteristics. The user is responsible for procuring a charging adapter cable compatible with the charging infrastructure.<\/li><li>Provision of charging current. The maximum charging power can be adjusted dynamically and cannot be guaranteed.<\/li><\/ul><h5>4. Tariffs<\/h5><p>The fees incurred for the use or rental of the car park shall be charged by Parcandi or, in the case of another owner or service provider, on their behalf.<\/p><p>4.1 Short-term parking<\/p><p>The charges for short-term parking are based on the uninterrupted rental period. There are basic, daily and monthly tariffs:<\/p><ul><li>The basic rate applies per hour or part thereof.<\/li><li>A maximum of one daily rate is charged per 24 hours (if the hourly costs exceed the daily rate for 24 hours or part thereof, only the daily rate is charged).<\/li><li>A maximum of one monthly rate is charged per 31 days (if the costs on a daily basis exceed the monthly rate for 31 days or part thereof, only the monthly rate is charged).<\/li><li>Basic, daily and monthly tariffs may vary per car park (even in the same property).<\/li><li style=\"list-style-type: none;\">\u00a0<\/li><\/ul><p>The fees include the statutory value added tax.<\/p><p>4.2 Long-term parking<\/p><p>The charges for long-term parking in a separately rented car park are based on a fixed monthly price that depends on the selected usage model.<\/p><p>The statutory value added tax is included in the fees. If the user uses another rental property within the building, no VAT is due unless the rental property is opted for.<\/p><\/div><div class=\"wp-block-coblocks-accordion-item__content\"><p>4.3 Additional services<\/p><p>The tariff valid for booking the additional service is displayed during the reservation enquiry. By making the enquiry, the user accepts the underlying tariff.<\/p><p>The tariff can be adjusted at any time by Parcandi or the owner at the next billing date. The new tariff will be communicated at least two weeks before the next billing date and will then apply from the next billing period.<\/p><p>The fees include the statutory value added tax.<\/p><p>The following tariff options are available for additional services:<\/p><ul><li>One-off price<\/li><li>Price per time unit (minute, hour, day, week, month, year)<\/li><li>Price depending on the power purchased<\/li><\/ul><p>4.3.1 Charging infrastructure<\/p><p>For the provision of the charging infrastructure for exclusive use by the user over a longer period of time, the user owes the monthly provision price.<\/p><p>This is charged to the user on a monthly basis. The monthly provision price does not include the electrical energy purchased by the user for charging the vehicle.<\/p><p>4.3.2 Charging current<\/p><p>There are two options for billing the charging current:<\/p><ul><li>Included charging current: The charging current is included in the car park tariff and paid for with it. The car parks are marked with &#8220;Charging current incl.&#8221;<\/li><li>Charging current according to consumption: The charging current is billed according to the power consumed in kWh. The user owes the variable price for the electricity actually drawn at the charging station as consumption costs based on the measured values of the charging station. The costs include expenses for meter reading and administration fees.<\/li><\/ul><h5>5. Payment<\/h5><p>5.1 Payment methods<\/p><p>Parcandi accepts as means of payment credit cards (Visa, Mastercard and American Express), PostFinance Card, PostFinance eFinance, PayPal, Google Pay, Samsung Pay, ApplePay, TWINT and purchase on account.<\/p><p>Purchase on account (including payment by installments) is processed by CembraPay AG (hereinafter &#8220;CembraPay&#8221;). The <a href=\"https:\/\/cembrapay.ch\/en\/terms\/CP\" target=\"_blank\" rel=\"noopener\">GTC<\/a> and the <a href=\"https:\/\/cembrapay.ch\/en\/privacy\" target=\"_blank\" rel=\"noopener\">privacy policy<\/a> of CembraPay shall apply.<\/p><p>Payment by invoice is only available under the following conditions:<\/p><ul><li>Registered account on Parcandi with a fully completed user profile.<\/li><li>The invoice amount is at least CHF 4.<\/li><\/ul><p>For recurring purchases, the GTC valid at the time of the recurring charge shall apply.<\/p><p>5.2 Payment modalities<\/p><p>The following payment methods apply to the payment of fees: <br \/>Payable on the day of the month in which use commenced (expiry date).<\/p><p class=\"p1\">If the user does not settle the outstanding amount by no later than seven days after the due date indicated on the invoice, the user will receive a first reminder. The first reminder is free of charge. If payment is still not made within a further 14 days from the date of the first reminder, a fee of CHF 20 will be charged with the second reminder. After an additional payment period of 14 days, a third reminder including a notice of debt collection will be sent, with a further fee of CHF 30. The payment period for the third reminder is 10 days.<\/p><p>Parcandi is entitled to charge the user default interest of 5% from the due date\u00a0 and all other costs and expenses associated with late payment.<\/p><p>For any legal proceedings, the user recognises the fees or the rent and all ancillary costs in accordance with the last legally valid rent adjustment.<\/p><p>If the tenant chooses payment methods that incur fees for Parcandi or the landlord\/owner (e.g. cash deposits at the post office counter), these costs will be charged to the tenant.<\/p><p>The tenant has paid on time if Parcandi can freely dispose of the money on the due date. Fees and rent payments will be credited to the item that has been due the longest, regardless of the reason for payment.<\/p><p>5.3 Debt collection, eviction\/expulsion<\/p><p>The tenant expressly acknowledges and accepts in advance that this usage agreement is deemed to be an acknowledgement of debt within the meaning of Art. 82 of the Federal Act on Debt Collection and Bankruptcy of 11 April 1889 (SchKG &#8211; SR 281.1) and entitles Parcandi, or the owner, to apply for provisional legal proceedings against the user for the collection of the rent, ancillary costs, compensation for unlawful use and for all other financial claims in connection with this rental agreement.<\/p><p>If Parcandi or the owner initiates debt collection or expulsion proceedings against the tenant, the tenant shall be obliged to reimburse the landlord for all other costs and fees incurred through the tenant&#8217;s fault, in addition to interest on arrears, debt collection and procedural costs.<\/p><h5>6. Promo codes<\/h5><p>Parcandi uses promo codes to grant customer benefits (e.g. free parking time) as part of marketing campaigns, customer benefit programmes or as a component of products. These can be offered by Parcandi or together with partner companies.<\/p><p>Users are not entitled to the issue of promo codes.<\/p><p>The promo code is made known to customers and can be used by them on the platform. The promo code must be entered in the field provided before the booking is made. The promo code will then be verified by Parcandi.<\/p><p>The validity of the promo codes issued may be limited in time. The respective validity period is defined in the corresponding offer.<\/p><p>The promo code cannot be combined with other promo codes, vouchers or discounts. The last promo code entered applies.<\/p><p>With some offers, the promo code can only be used with the mobile phone number used for the first time and therefore cannot be transferred. A change of mobile phone number is only possible via customer support (+41 61 512 45 05, kundenservice@parcandi.ch).<\/p><p>If you are entitled to compensation for your booking (full or partial refund) then such compensation will not include the amount of the promo code value.<\/p><p>Parcandi reserves the right to unilaterally change the conditions of the promo codes or to stop issuing them at any time.<\/p><p>In the event of misuse, these may be rejected in accordance with the following <strong>Fair Use Policy<\/strong>:<\/p><ul><li>The customer is responsible for the careful handling of the promo code. The customer alone is liable for any misuse of the promo code.<\/li><li>In the event of obvious misuse, Parcandi reserves the right to deactivate the promo code without prior notice. The resale or trading of promo codes is prohibited.<\/li><li>If Parcandi has to take measures against the misuse of the promo code, the customer will be charged an expense allowance of CHF 100. Parcandi reserves the right to claim further damages.<\/li><\/ul><h5>7. Liability provisions<\/h5><p>The user is fully and unrestrictedly liable to Parcandi and the owner\/landlord for all breaches of these GTC.<\/p><p>The user undertakes to indemnify Parcandi and the owner\/landlord for all claims made against them in connection with breaches of these GTC.<\/p><p>The user is liable for all damage to the rented property, the rented property and its surroundings caused by himself, his family members and\/or his employees or by third parties accompanying him.<\/p><p>The user must notify Parcandi immediately of any defects and\/or damage caused by the user in accordance with section 8.1.<\/p><p>In the event of sudden defects in the rented property that constitute an emergency that cannot be postponed, the user is obliged to inform Parcandi, the caretaker, the management or the owner immediately or, in their absence, to take the absolutely necessary precautions to prevent consequential damage, as far as possible and reasonable.<\/p><p>The user is liable for any damage caused by the failure to notify Parcandi.<\/p><p>The user is obliged to use the rental property carefully and to keep it clean and in good condition. The tenant is responsible for all damage resulting from unauthorised use of the rented property.<\/p><p>Use of the car parks (including any additional services) is at your own risk and responsibility. Vehicles and persons are not guarded.<\/p><p>Parcandi accepts no liability for accidents, personal injury or damage to property.<\/p><p>Parcandi accepts no liability for theft or damage to property by third parties or for damage caused by external influences (fire, explosion, water, ice, snow, etc.).<\/p><p>The landlord is liable for all damage arising in the context of the tenancy within the scope of statutory liability (owner&#8217;s liability).<\/p><p>Liability on the part of Parcandi or the owner for direct or indirect damage caused by negligence, as well as for consequential damage, third-party damage and loss of profit resulting from the use of the car park or the purchase of additional services (e.g. purchase of charging current) is excluded to the extent permitted by law. The exclusion of liability also includes the non-provision or delayed provision of a car park or an additional service (e.g. charging current).<\/p><p>Parcandi and\/or the landlord\/owner are authorised to carry out maintenance, repair and adaptation work that the rented property, the associated facilities and installations and the common parts of the building require, subject to prior notice.<\/p><p>The user must tolerate necessary work at all times and grant free access to the individual garage\/car park rented by him for this purpose. If he refuses to allow the workmen access to the rented property, he may be held liable for additional costs and consequential damage. This work only entitles the tenant to compensation or a reduction in rent if it leads to an actual reduction in use.<\/p><p>Parcandi and the owner accept no liability for the availability of the car park and any associated consequential costs. This applies in particular if the car park is illegally occupied by other users or third parties. If available and after consultation with Parcandi, the user can reserve a suitable alternative car park.<\/p><p>The installation and use of the app is at your own risk. Parcandi and the owner assume no warranty for the App and provide no support. Parcandi and the owner do not guarantee that the App and the services will function or be available at all times without error or interruption, or that errors will be rectified.<\/p><p>To the extent permitted by law, Parcandi and the owner disclaim any liability for the accuracy, appropriateness and timeliness of the information provided via the App or made available on Parcandi or third party websites. In particular, Parcandi and the owner accept no responsibility or liability whatsoever for actions taken or not taken on the basis of this information.<\/p><p>The app may contain hyperlinks to third-party websites (hereinafter: &#8220;third-party websites&#8221;) that are not operated by Parcandi or the owner. Users access such hyperlinks at their own risk. The user accepts that Parcandi and the owner are not responsible for checking or evaluating the content on these third-party websites. The contents of the third-party websites do not necessarily reflect the opinion of Parcandi or the owner. Parcandi and the owner accept no liability for the content of such third-party websites.<\/p><p>To the extent permitted by law, Parcandi and the owner disclaim any liability for inherent risks on the Internet. This includes in particular<\/p><ul><li>technical or organisational difficulties in receiving or transmitting the data<\/li><li>technical defects, faults or interruptions in the telephone network or Internet access<\/li><li>unlawful interference by third parties in hardware, software or networks<\/li><li>Placing viruses<\/li><li>Copying and falsifying data and information<\/li><li>Network overload<\/li><li>wilful or accidental blocking of electronic access caused by third parties.<\/li><li style=\"list-style-type: none;\">\u00a0<\/li><\/ul><p>Parcandi and the owner disclaim, to the extent permitted by law, any liability for damages related to accessing the app from abroad.<\/p><h5>8. Due diligence obligations for the purchase of charging current<\/h5><p>The user is obliged to use the charging station in accordance with its purpose and technical characteristics.<\/p><p>The user undertakes to handle the charging station and its accessories (plug, charging cable, RFID card) with care. Only rechargeable electric or hybrid vehicles may be connected to the charging station that are authorised for road traffic, whose components comply with the statutory regulations and which are in a ready-to-use, safe and professionally maintained condition.<\/p><p>The user is obliged to comply with the specifications of the respective vehicle manufacturer and to follow the instructions and instructions for use of the lessor and the manufacturer of the charging station.<\/p><p>The user must observe the warning messages issued by warning lights at the charging station and\/or from the vehicle and immediately take all necessary measures to protect his own safety, the safety of third parties and the integrity of the vehicle and the rental object or the rental property.<\/p><p>The user shall not carry out any manipulations or other actions on the charging station that have not been agreed with the lessor and that are likely to have a negative impact on the charging solution or damage the charging station.<\/p><p>The user shall notify Parcandi of any defects or malfunctions of the charging solution of which he becomes aware as soon as they are discovered.<\/p><p>The user is liable for all damage caused in disregard of this section 8.<\/p><h5>9. Rights of use and ownership<\/h5><p>Parcandi grants the user the limited, non-transferable, non-exclusive right to use the app and the services offered therein.<\/p><p>Parcandi retains full ownership and copyright of all content.<\/p><p>Parcandi retains exclusive ownership of all resulting rights regarding reproduction, marketing and distribution (including renting, lending, leasing and licensing) as well as ownership of the application.<\/p><h5>10. Assignment of user rights<\/h5><p>By using the app, the user grants Parcandi the free, irrevocable, unlimited, unrestricted and non-exclusive right to use, reproduce, modify, adapt, publish, translate, distribute and display all remarks, suggestions for improvement, comments, ideas, images and graphics as well as all other information transmitted to Parcandi through this app.<\/p><h5>11. Changes<\/h5><p>These GTC may be amended by Parcandi at any time at its own discretion. By continuing to use the app after a change to the GTC, the user accepts the changes in full and without reservation.<\/p><p>Parcandi undertakes to draw attention to changes in utilisation.<\/p><h5>12. Authoritative version<\/h5><p>In the event of ambiguities in the various language versions of the GTCs, the German version shall prevail.<\/p><h5>13. Severability clause<\/h5><p>Should any of the above provisions violate applicable law, this shall not affect the validity of the remaining provisions.<\/p><p>In this case, the invalid provision shall be replaced with a legally compliant provision that comes as close as possible to the meaning of the original provision.<\/p><h5>14. Applicable law \/ Place of jurisdiction<\/h5><p>The tenancy, usage relationship and use of the application are governed exclusively by substantive Swiss law.<\/p><p>The provisions of the Swiss Code of Obligations (CO, tenancy law) or Civil Code (CC, real estate law) and, if applicable, the Road Traffic Act (RTA) and the associated ordinances, which are also applicable to the present contractual relationship, apply in the buildings or on the land of the rented car park.<\/p><p>The place of jurisdiction for all legal disputes arising from the usage relationship and the tenancy is Basel-Stadt. Mai 2023<\/p><ol><li><strong>Allgemeines | Geltungsbereich<\/strong><ol><li>Diese Parcandi Nutzungsbedingungen Deutschland (\u201e<strong>Nutzungsbedingungen<\/strong>\u201c) gelten f\u00fcr alle Vertr\u00e4ge zwischen der Parcandi Europe GmbH (\u201e<strong>Parcandi<\/strong>\u201c) und Nutzern (\u201e<strong>Nutzer<\/strong>\u201c) der unter anderem \u00fcber mobile Apps und Internetbrowser zug\u00e4nglichen Software-Plattform (\u201e<strong>Plattform<\/strong>\u201c) von Parcandi zur Vermittlung von Mietvertr\u00e4gen \u00fcber Kfz-Stellpl\u00e4tze (\u201e<strong>Stellpl\u00e4tze<\/strong>\u201c) auf Freifl\u00e4chen oder in Parkh\u00e4usern (\u201e<strong>Parkobjekte<\/strong>\u201c) auf dem Gebiet der Bundesrepublik Deutschland. Nutzer im Sinne dieser Nutzungsbedingungen k\u00f6nnen sowohl Verbraucher im Sinne von \u00a7\u00a013 BGB als auch Unternehmer im Sinne von \u00a7\u00a014 BGB sein. Diese Nutzungsbedingungen werden Bestandteil jedes Nutzungs\u00ad\u00ad\u00advertrages.<\/li><li>Diese Nutzungsbedingungen gelten f\u00fcr und werden Bestandteil von allen Bestelldokumenten und Bestellvorg\u00e4ngen, die online, per E-Mail oder \u00fcber eine App durchgef\u00fchrt und zwischen Parcandi und dem Nutzer vereinbart werden.<\/li><li>Diese Nutzungsbedingungen gelten auch f\u00fcr k\u00fcnftige Vertr\u00e4ge zwischen Parcandi und dem Nutzer, ohne dass es im Einzelfall eines entsprechenden Hinweises durch Parcandi bedarf. Diese Bedingungen gelten sp\u00e4testens dann als von dem Nutzer best\u00e4tigt, wenn der Nutzer die Leistungen von Parcandi in Anspruch nimmt.<\/li><li>Diese Nutzungsbedingungen gelten unter Ausschluss aller anderen Bedingungen. Abweichende, widersprechende oder erg\u00e4nzende allgemeine Gesch\u00e4ftsbedingungen des Nutzers werden nur Vertragsbestandteil, soweit Parcandi ihnen schriftlich zugestimmt hat.<\/li><li>Sofern in diesen Nutzungsbedingungen die Begriffe \u201aschriftlich\u2018, \u201ain Schriftform\u2018 oder \u00e4hnliche verwendet werden, beziehen sich diese auf die Schriftform im Sinne von \u00a7\u00a0126 BGB. Der elektronische Austausch von Kopien handschriftlich unterzeichneter Dokumente sowie von Dokumenten mit einer einfachen elektronischen Signatur (wie beispielsweise mit Hilfe von DocuSign oder Adobe Sign) ist insoweit ausreichend. Soweit nicht in diesen Nutzungsbedingungen ausdr\u00fccklich etwas anderes bestimmt ist, ist daf\u00fcr der Austausch einfacher E-Mails oder die Kommunikation \u00fcber die Plattform oder \u00fcber einen von Parcandi unterst\u00fctzten Nachrichtendienst (z.\u00a0B. SMS oder WhatsApp) nicht ausreichend.<\/li><li>Alle Mitteilungen und Erkl\u00e4rungen, die der Nutzer gegen\u00fcber Parcandi abgibt, sind mindestens in Textform im Sinne von \u00a7\u00a0126b BGB (zur Klarstellung: eine einfache E-Mail oder die Kommunikation \u00fcber die Plattform oder \u00fcber einen von Parcandi unterst\u00fctzten Nachrichtendienst (z.\u00a0B. SMS oder WhatsApp) ist daf\u00fcr ausreichend) oder in einer strengeren Form abzugeben, sofern nicht in diesen Nutzungsbedingungen im Einzelfall etwas anderes bestimmt ist. K\u00fcndigungen per SMS sind unzul\u00e4ssig.<\/li><li>Verweise in diesen Nutzungsbedingungen auf die Anwendbarkeit gesetzlicher Vorschriften dienen nur der Klarstellung. Folglich gelten die gesetzlichen Vorschriften auch dann, wenn eine solche Klarstellung nicht erfolgt, es sei denn, die gesetzlichen Vorschriften werden in diesen Nutzungsbedingungen erg\u00e4nzt oder ausdr\u00fccklich ausgeschlossen.<\/li><li>Aus Gr\u00fcnden der Praktikabilit\u00e4t wird in diesen Nutzungsbedingungen auf die gleichzeitige Verwendung weiblicher, m\u00e4nnlicher und diverser Sprachformen verzichtet und das generische Maskulinum verwendet. S\u00e4mtliche Personenbezeichnungen gelten gleicherma\u00dfen f\u00fcr s\u00e4mtliche Geschlechter.<\/li><\/ol><\/li><li><strong>Plattform | Leistungen | Registrierung | Nutzungsvertrag<\/strong><ol><li>Parcandi erm\u00f6glicht es dem Nutzer, \u00fcber die Plattform von Dritten (\u201e<strong>Vermietern<\/strong>\u201c) Stellpl\u00e4tze anzumieten. Der Zugang zur Plattform ist f\u00fcr den Nutzer kostenfrei.<\/li><li>Voraussetzung f\u00fcr die Inanspruchnahme der Leistungen von Parcandi ist, dass der Nutzer sich auf der Plattform registriert. Dazu kann der Nutzer auf der Plattform bestimmte pers\u00f6nliche Daten eingeben, in einem von Parcandi online zur Verf\u00fcgung gestellten Anmeldeformular ein Passwort seiner Wahl festlegen und, ggf. erst nach Eingabe eines Einladungs-Codes, ein Nutzerkonto anlegen (\u201e<strong>Nutzerkonto<\/strong>\u201c). Nach Abschluss der Registrierung erh\u00e4lt der Nutzer in der Regel eine SMS von Parcandi, die es ihm erlaubt, sein Nutzerkonto zu aktivieren. Parcandi beh\u00e4lt sich vor, Registrierungen nach eigenem Ermessen ohne Angabe von Gr\u00fcnden abzulehnen. Mit Aktivierung des Nutzerkontos kommt zwischen Parcandi und dem Nutzer ein verbindlicher Vertrag \u00fcber die Nutzung der Plattform zustande (\u201e<strong>Nutzungsvertrag<\/strong>\u201c).<\/li><li>Der Nutzer ist verpflichtet, die Adressdaten in seinem Nutzerkonto auf dem aktuellen Stand zu halten und steht f\u00fcr deren Richtigkeit und Vollst\u00e4ndigkeit ein. Der Nutzer ist verpflichtet, Parcandi \u00c4nderungen solcher Daten unverz\u00fcglich mitzuteilen. Bis zur Mitteilung von \u00c4nderungen ist Parcandi berechtigt, aber nicht verpflichtet, die bisherigen Daten f\u00fcr die Erf\u00fcllung seiner vertragsgegenst\u00e4ndlichen Pflichten zu verwenden.<\/li><li>Der Nutzer darf nur ein einzelnes Nutzerkonto unterhalten. Er stellt sicher, dass Nutzerkennungen und Passw\u00f6rter, die der Nutzer im Zuge der Registrierung auf der Plattform erh\u00e4lt, auf sichere Weise gespeichert, aufbewahrt und verwendet werden und Dritte darauf keinen Zugriff haben.<\/li><li>Parcandi ist berechtigt, zur Erf\u00fcllung seiner vertraglichen Pflichten jederzeit Unterauftragnehmer zu beauftragen.<\/li><\/ol><\/li><li><strong>Zustandekommen von Mietvertr\u00e4gen \u00fcber Stellpl\u00e4tze<\/strong><ol><li>Parcandi bietet dem Nutzer die M\u00f6glichkeit, (a) \u00fcber die Plattform oder, soweit verf\u00fcgbar, (b) durch das Heranfahren eines Fahrzeugs an eine am Parkobjekt gegebenenfalls installierte automatische Kfz-Kennzeichenerkennungsanlage (\u201e<strong>KE-Anlage<\/strong>\u201c) bei einem Vermieter eine Reservierungsanfrage f\u00fcr einen Stellplatz zu stellen (jeweils eine \u201e<strong>Reservierungsanfrage<\/strong>\u201c). Der Nutzer hat mit der Reservierungsanfrage keinen Anspruch auf einen Stellplatz.<\/li><li>Durch das Stellen einer Reservierungsanfrage akzeptiert der Nutzer die jeweils f\u00fcr das Parkobjekt geltenden Nutzungsvorschriften bzw. Hausordnung des Vermieters (\u201e<strong>Stellplatzbedingungen<\/strong>\u201c).<\/li><li>Bei einer von dem Nutzer abgegebenen Reservierungsanfrage handelt es sich um ein Angebot des Nutzers an den jeweiligen Vermieter auf Abschluss eines Mietvertrages \u00fcber den betreffenden Stellplatz. Der Vermieter ist nicht verpflichtet, ein Angebot des Nutzers anzunehmen.<\/li><li>Der Vermieter kann das Angebot des Nutzers annehmen, indem er (a) dem Nutzer \u00fcber die Plattform durch Parcandi eine Reservierungsbest\u00e4tigung f\u00fcr einen Stellplatz auf bzw. in dem betreffenden Parkobjekt sendet oder (b) im Falle der Nutzung einer KE-Anlage nach erfolgter Kennzeichenerkennung die Zufahrt zu einem Parkobjekt gew\u00e4hrt. Der entsprechende Mietvertrag kommt ausschlie\u00dflich zwischen dem Nutzer und dem Vermieter nach Ma\u00dfgabe der zwischen ihnen getroffenen Abreden zustande. Parcandi wird nicht Partei eines solchen Vertrages. Vermieter sind nicht Erf\u00fcllungsgehilfen Parcandis.<\/li><li>Die dem Nutzer auf der Plattform angezeigten Stellpl\u00e4tze und Vermieterinformationen stellen eine unverbindliche Auflistung dar. Parcandi steht nicht f\u00fcr deren Richtigkeit und Aktualit\u00e4t ein. Parcandi steht zudem nicht daf\u00fcr ein, dass und mit welchen Stellpl\u00e4tzen ein bestimmter Vermieter auf der Plattform vertreten ist.<\/li><li>Parcandi steht nicht f\u00fcr die Richtigkeit und Aktualit\u00e4t der dem Nutzer auf der Plattform angezeigten Mieth\u00f6he ein. Vorbehaltlich der Regelung in Ziffer\u00a012 steht Parcandi nicht f\u00fcr die Verf\u00fcgbarkeit des ausgew\u00e4hlten Stellplatzes ein. Dies gilt insbesondere, wenn der Stellplatz widerrechtlich belegt ist. Bei Verf\u00fcgbarkeit und nach R\u00fccksprache mit Parcandi kann der Nutzer ggf. einen geeigneten Ausweichstellplatz mieten.<\/li><\/ol><\/li><li><strong>Laufzeit und Beendigung von Mietvertr\u00e4gen \u00fcber Stellpl\u00e4tze<\/strong><ol><li>Der Nutzer kann einen Mietvertrag jederzeit ordentlich ohne eine Frist beenden bzw. k\u00fcndigen. Dazu muss der Nutzer (a) nach Verlassen des Stellplatzes bzw., wenn er den Stellplatz nicht mehr ben\u00f6tigt, die entsprechende Buchung in der App zu beenden oder (b), im Falle des Zustandekommens des Vertrages durch die Nutzung einer KE-Anlage, das Parkobjekt mit dem Fahrzeug durch erneutes Nutzen der KE-Anlage bei der Ausfahrt verlassen, soweit nicht eine l\u00e4ngere Mietdauer vereinbart worden ist.<\/li><li>Der Vermieter kann den Mietvertrag jederzeit mit angemessener Frist ordentlich k\u00fcndigen. Dieses Recht wird der Vermieter beispielsweise dann aus\u00fcben, wenn Unterhaltsarbeiten an dem Parkobjekt durchgef\u00fchrt werden m\u00fcssen oder der Vermieter die Parkpl\u00e4tze vor\u00fcbergehend oder dauerhaft aus dem Angebot bei Parcandi entfernt.<\/li><li>Das Recht der Parteien zur au\u00dferordentlichen fristlosen K\u00fcndigung des Mietvertrages aus wichtigem Grund bleibt unber\u00fchrt. F\u00fcr Parcandi liegt ein solcher wichtiger Grund insbesondere in einem Versto\u00df des Nutzers gegen die Geb\u00e4udeordnung oder die Nutzungsbedingungen.<\/li><\/ol><\/li><li><strong>Pflichten des Nutzers in Bezug auf die Nutzung von Stellpl\u00e4tzen<\/strong><ol><li>Vorbehaltlich abweichender Regelungen in den Stellplatzbedingungen ist der Nutzer verpflichtet, die in dieser Ziffer 5 festgelegten Nutzungsregeln einzuhalten. Diese Verpflichtung des Nutzers besteht sowohl gegen\u00fcber Parcandi als auch gegen\u00fcber dem betreffenden Vermieter (echter Vertrag zu Gunsten Dritter im Sinne von \u00a7\u00a0328 BGB). Der Nutzer ist verpflichtet, Parcandi bzw. dem Vermieter, die infolge der Missachtung dieser Nutzungsregeln entstehenden Aufw\u00e4nde nach Ma\u00dfgabe dieser Nutzungsbedingungen zu ersetzen.<\/li><li>Der Nutzer ist verpflichtet, die f\u00fcr die Nutzung des jeweils gemieteten Stellplatzes geltenden Stellplatzbedingungen vollumf\u00e4nglich zu beachten.<\/li><li>In den Geb\u00e4uden bzw. auf den Grundst\u00fccken des vermieteten Stellplatzes gilt die Stra\u00dfenverkehrsordnung (StVO).<\/li><li>Um das Parkobjekt befahren zu k\u00f6nnen ist in der Regel ein internetf\u00e4higes Mobiltelefon mit einem \u00fcblichen und aktuellen Betriebssystem notwendig (z. B. zum \u00d6ffnen des Tores). Den Weisungen von Parcandi bzw. des Eigent\u00fcmers oder Hausrechtsinhabers des jeweiligen Parkobjekts ist Folge zu leisten.<\/li><li>Fahrzeuge d\u00fcrfen nur innerhalb der von dem Nutzer reservierten und durch Parcandi \/ den Vermieter bestimmten Parkfelder innerhalb der Markierung abgestellt werden. Wenn die Reservierungsbest\u00e4tigung auf einen festen Stellplatz mit Stellplatznummer verweist, ist diese bindend. Ein Parken au\u00dferhalb dieses Stellplatzes ist in diesem Fall nicht gestattet.<\/li><li>Folgende Handlungen sind dem Nutzer untersagt und der Nutzer wird daf\u00fcr Sorge tragen, dass auch Dritte die folgenden Handlungen unterlassen: (a) das Verweilen auf bzw. in den Parkobjekten, (b) jede sachfremde Nutzung der Stellpl\u00e4tze und Parkobjekte (z.\u00a0B. das Lagern von Waren, Reparieren oder Waschen von Fahrzeugen, Verursachen von Verunreinigungen, Befahren mit Spiel- und Sportger\u00e4ten), (c) das Verteilen von Werbematerialien und das Plakatieren auf bzw. in den Parkobjekten, sowie (d) das Rauchen auf bzw. in den Parkobjekten.<\/li><li>Der Nutzer ist verpflichtet, etwaige Besch\u00e4digungen und Defekte an bzw. in den Parkobjekten und ihrer Einrichtungen (Schranken, Kassen, Lifte, Beleuchtung, Signale, KE-Anlage usw.) an Parcandi bzw. dem Vermieter zu melden. Unf\u00e4lle in den Parkobjekten mit Personensch\u00e4den sind vom Nutzer der Polizei zu melden.<\/li><li>Nach dem Ende der Mietzeit ist der Stellplatz unverz\u00fcglich freizugeben. Widerrechtlich oder verkehrsbehindernd abgestellte Fahrzeuge k\u00f6nnen geb\u00fchrenpflichtig entfernt oder festgesetzt werden.<\/li><\/ol><\/li><li><strong>Miete und Verg\u00fctung<\/strong><ol><li>Parcandi zieht die Miete f\u00fcr den Stellpl\u00e4tze f\u00fcr den Vermieter vom Nutzer ein.<\/li><li>Die H\u00f6he der Miete richtet sich nach dem Mietvertrag und der jeweiligen Mietdauer. Es gibt Basis- , Tages- und Monatstarife:<ul><li>Der Basistarif gilt pro angefangene Stunde.<\/li><li>Pro 24h wird maximal ein Tagestarif abgerechnet (wenn f\u00fcr angefangene 24h die Kosten auf Stundenbasis den Tagestarif \u00fcbersteigen, wird nur den Tagestarif abgerechnet).<\/li><li>Pro 31 Tage wird maximal ein Monatstarif abgerechnet (wenn f\u00fcr angefangene 31 Tage die Kosten auf Tagesbasis den Monatstarif \u00fcbersteigen, wird nur den Monatstarif abgerechnet).<\/li><li>Basis-, Tages- und Monatstarif k\u00f6nnen je nach Stellplatz unterschiedlich sein.<\/li><\/ul><\/li><li>Die Miete versteht sich einschlie\u00dflich der gesetzlich geschuldeten Mehrwertsteuer.<\/li><li>Die Miete ist mit Beendigung des Mietvertrages f\u00e4llig. Bei einer \u00fcber einen Monat hinausgehenden Nutzung des Stellplatzes kann eine monatliche F\u00e4lligkeit der Miete vereinbart werden.<\/li><li>Die Bezahlung der Miete durch den Nutzer erfolgt \u00fcber eine der auf der Plattform genannten Zahlungsarten.<\/li><\/ol><\/li><li><strong>Laufzeit und Beendigung des Nutzungsvertrages \u00fcber die Plattform<\/strong><ol><li>Der Nutzungsvertrag l\u00e4uft auf unbestimmte Zeit. Jede Partei kann den Nutzungsvertrag jederzeit unter Einhaltung einer Frist von 1 Woche zum Ende eines Kalendermonats gegen\u00fcber der anderen Partei ordentlich k\u00fcndigen.<\/li><li>Das Recht der Parteien zur au\u00dferordentlichen fristlosen K\u00fcndigung des Nutzungsvertrages aus wichtigem Grund bleibt unber\u00fchrt. Ein wichtiger, Parcandi zu einer solchen K\u00fcndigung berechtigender Grund liegt insbesondere vor, wenn der Nutzer die Leistungen von Parcandi missbr\u00e4uchlich einsetzt (einschlie\u00dflich deren kommerzielle Nutzung f\u00fcr eigene oder fremde Zwecke) und\/oder manipuliert oder seine Pflichten aus diesen Nutzungsbedingungen sonst schwerwiegend und\/oder fortgesetzt verletzt und Parcandi dadurch eine Fortsetzung der Vertragsverh\u00e4ltnisses nicht zumutbar ist.<\/li><li>Parcandi ist berechtigt und gegen\u00fcber dem Nutzer verpflichtet, mit dem Nutzerkonto zusammenh\u00e4ngende Daten nach Ablauf einer Vorhaltezeit von 30 Tagen nach Ende des Vertragsverh\u00e4ltnisses unwiederbringlich zu l\u00f6schen. Hierzu geh\u00f6ren insbesondere die Daten \u00fcber geschlossene Mietvertr\u00e4ge. Es obliegt dem Nutzer, diejenigen Daten, die er nach Ende des Nutzungsvertrages weiterverwenden m\u00f6chte, rechtzeitig vor Vertragsende durch Herunterladen auf ein eigenes Speichermedium zu sichern. Von der L\u00f6schung ausgenommen sind jedoch solche Daten, zu deren weiteren Speicherung Parcandi aus steuerrechtlichen, handelsrechtlichen oder sonstigen gesetzlichen Gr\u00fcnden verpflichtet ist.<\/li><\/ol><\/li><li><strong>Nutzungsrechte | Nutzungsbeschr\u00e4nkungen<\/strong><ol><li>Nach Ma\u00dfgabe des Nutzungsvertrages gew\u00e4hrt Parcandi dem Nutzer w\u00e4hrend der Dauer des Nutzungsvertrages ein einfaches, nicht \u00fcbertragbares, nicht unterlizenzierbares Recht, die Plattform zum Zwecke der Inanspruchnahme der Leistungen von Parcandi zu nutzen. Die Plattform wird so angeboten wie jeweils aktuell auf der Website von Parcandi einschlie\u00dflich dem Abschnitt \u00fcber h\u00e4ufig gestellte Fragen (FAQ) beschrieben.<\/li><li>Der Nutzer darf nicht (und darf nicht gestatten, dass Dritte dies tun) mittelbar oder unmittelbar: (a) die Plattform oder Teile davon unterlizenzieren, \u00fcbertragen, vertreiben, teilen, oder anderweitig Einnahmen aus der Plattform generieren; (b) die Plattform oder Teile davon auf ein \u00f6ffentliches oder verteiltes Netzwerk kopieren; (c) alle oder einen Teil der Plattform modifizieren, anpassen, \u00fcbersetzen oder abgeleitete Werke erstellen, die auf der Plattform basieren; (d) Hinweise auf Eigentumsrechte, die in der Plattform oder Teilen davon erscheinen, modifizieren; (e) die Plattform au\u00dferhalb des in dieser Ziffer\u00a08 beschriebenen Lizenzumfangs nutzen; oder (f) die Plattform verwenden, um (i) verletzendes, verleumderisches oder auf andere Weise unrechtm\u00e4\u00dfiges oder unerlaubtes Material oder b\u00f6sartige Codes oder Malware zu speichern, herunterzuladen oder zu \u00fcbertragen; (ii) Phishing, Spamming, Denial-of-Service-Angriffen oder anderen betr\u00fcgerischen oder kriminellen Aktivit\u00e4ten nachzugehen; (iii) die Integrit\u00e4t oder die Leistungsf\u00e4higkeit von Systemen Dritter oder die darin enthaltenen Angebote oder Daten zu beeintr\u00e4chtigen oder zu unterbrechen; (iv) zu versuchen, unerlaubten Zugriff auf die Plattform oder die Systeme oder Netzwerke von Parcandi zu erlangen; oder (v) Penetrationstests, Schwachstellenanalysen oder andere Sicherheitsbewertungen durchzuf\u00fchren oder Dritte mit deren Durchf\u00fchrung zu beauftragen.<\/li><li>Der Nutzer darf den Betrieb der Plattform nicht st\u00f6ren und die darin zug\u00e4nglichen Daten nicht au\u00dferhalb der vertraglich vorgesehen Nutzung nutzen. Der Nutzer darf die Plattform insbesondere nicht mit dem Ziel manipulieren, unberechtigte Zahlungen oder sonstige Vorteile zum Nachteil von Parcandi oder Dritter zu erlangen.<\/li><li>Der Nutzer darf die Plattform nur so nutzen, wie jeweils aktuell auf der Website von Parcandi einschlie\u00dflich dem Abschnitt \u00fcber h\u00e4ufig gestellte Fragen (FAQ) beschrieben.<\/li><\/ol><\/li><li><strong>Pflichten des Nutzers in Bezug auf die Plattform<\/strong><ol><li>Der Nutzer ist verpflichtet, die Plattform nur unter vollst\u00e4ndiger Beachtung aller geltenden Gesetze und Vorschriften zu nutzen.<\/li><li>Der Nutzer ist verpflichtet, technische Ger\u00e4te und damit zusammenh\u00e4ngende Zusatzdienste, die f\u00fcr die nutzerseitige Verbindung mit, den nutzerseitigen Zugriff auf oder die sonstige Nutzung der Plattform durch den Nutzer erforderlich sind, auf eigene Kosten zu beschaffen und instand zu halten. Dies betrifft insbesondere Hardware, Software, Server, Betriebssysteme, Netzwerke und mobile Endger\u00e4te (gemeinsam \u201e<strong>Technische Ausstattung<\/strong>\u201c). Parcandis Anforderungen an die Technische Ausstattung k\u00f6nnen in ihrer jeweils aktuellen Fassung auf der Plattform bzw. der Website von Parcandi eingesehen werden. F\u00fcr die Nutzung der Plattform ist jedenfalls ein internetf\u00e4higes Mobiltelefon mit einem \u00fcblichen und aktuellen Betriebssystem notwendig.<\/li><li>Der Nutzer ist allein f\u00fcr die Sicherheit der Technischen Ausstattung sowie jede dem Nutzer bekannte oder unbekannte Nutzung der Technischen Ausstattung verantwortlich.<\/li><li>Der Nutzer ist f\u00fcr die Inhalte aller Daten, die von dem Nutzer \u00fcber oder mit Hilfe der Plattform angezeigt, hochgeladen, gespeichert, ausgetauscht oder \u00fcbertragen werden (gemeinsam \u201e<strong>Inhalte<\/strong>\u201c), allein verantwortlich. Parcandi ist nicht in der Lage, die von dem Nutzer w\u00e4hrend der Nutzung der Plattform ggf. \u00fcbermittelten Informationen zu kontrollieren oder die Richtigkeit dieser Informationen zu gew\u00e4hrleisten.<\/li><li>Parcandi ist berechtigt, ohne vorherige Ank\u00fcndigung und ohne daf\u00fcr zu haften, mutma\u00dflichen Verletzungen des Nutzungsvertrages durch den Nutzer nachzugehen und kann gegen\u00fcber dem Nutzer rechtliche und\/oder technische Ma\u00dfnahmen ergreifen, die Parcandi f\u00fcr angemessen erachtet, um solche Verletzungen abzustellen. Zu diesen Ma\u00dfnahmen geh\u00f6ren das Beschr\u00e4nken, Sperren oder K\u00fcndigen des Zugangs des Nutzers zu der Plattform.<\/li><li>Im Falle einer nicht autorisierten Verwendung eines Passworts oder des Nutzerkontos, einer anderen bekannten oder vermuteten Sicherheitsverletzung oder eines Missbrauchs der Plattform ist der Nutzer verpflichtet, Parcandi dar\u00fcber unverz\u00fcglich zu informieren. Der Nutzer haftet f\u00fcr jede unbefugte Verwendung des Nutzerkontos.<\/li><\/ol><\/li><li><strong>Eigentumsrechte | Nutzerdaten | Sicherheit | Feedback | Keine weitergehende Verpflichtungen<\/strong><ol><li>Parcandi und Parcandis etwaige Auftragnehmer sind und bleiben Inhaber aller Eigentumsrechte, einschlie\u00dflich Urheberrechten, Datenbankrechten, Patenten, Gesch\u00e4ftsgeheimnissen, Marken und aller anderen Rechte an geistigem Eigentum und technischen L\u00f6sungen an und im Zusammenhang mit der Plattform. Der Nutzer erkennt an, dass die nach einem Nutzungsvertrag gew\u00e4hrten Rechte dem Nutzer keine Eigentumsrechte an der Plattform verschaffen.<\/li><li>S\u00e4mtliche Rechte an den Inhalten und an Daten, die der Nutzer Parcandi zur Verf\u00fcgung stellt, um die Bereitstellung der Plattform zu erm\u00f6glichen oder die der Nutzer w\u00e4hrend der Nutzung der Plattform zur Verf\u00fcgung stellt (\u201e<strong>Nutzerdaten<\/strong>\u201c), sowie an Daten, die auf den Inhalten oder Nutzerdaten basieren oder davon abgeleitet sind, verbleiben bei dem Nutzer. Der Nutzer r\u00e4umt Parcandi ein einfaches, nicht \u00fcbertragbares, unterlizenzierbares, r\u00e4umlich und inhaltlich unbeschr\u00e4nktes (Nutzungs-)Recht ein, die Inhalte und Nutzerdaten zum Zwecke der Bereitstellung der Plattform, einschlie\u00dflich der Weitergabe an Vermieter, umfassend zu nutzen. Der Nutzer erkl\u00e4rt, dass er die Inhalte und Nutzerdaten mit Parcandi teilen darf und \u00fcber ausreichende Rechte zu deren Weitergabe an Parcandi verf\u00fcgt. Vorbehaltlich der Regelungen in Ziffer\u00a012 ist Parcandi f\u00fcr die Inhalte und die Nutzerdaten nicht verantwortlich.<\/li><li>Parcandi wird angemessene Ma\u00dfnahmen ergreifen, um zu gew\u00e4hrleisten, dass die Sicherheit der Plattform markt\u00fcblichen Industriestandards entspricht.<\/li><li>Der Nutzer kann Parcandi gelegentlich Vorschl\u00e4ge f\u00fcr neue Eigenschaften oder Funktionen der Plattform unterbreiten oder sonstiges Feedback zu der Plattform geben. Es steht Parcandi frei solche Vorschl\u00e4ge oder solches Feedback zu ber\u00fccksichtigen. Der Nutzer gew\u00e4hrt Parcandi kostenfrei ein vollst\u00e4ndig abgegoltenes, unbefristetes, unterlizenzierbares Recht, ein solches Feedback zu jeglichem Zweck zu nutzen.<\/li><li>Parcandi hat das Recht, den Umfang, die Funktionen und\/oder den Inhalt der Plattform jederzeit und ohne Vorank\u00fcndigung upzudaten, upzugraden, herabzustufen, einzuschr\u00e4nken oder anderweitig zu modifizieren. Vorbehaltlich der Regelungen in Ziffer\u00a012 treffen Parcandi f\u00fcr die Plattform keine Garantie-, Entsch\u00e4digungs-, Wartungs-, Support- oder Verf\u00fcgbarkeitsverpflichtungen.<\/li><\/ol><\/li><li><strong>Datenschutz<\/strong><ol><li>Der Nutzer und Parcandi werden jederzeit die Anforderungen des geltenden Datenschutzrechts, insbesondere der DSGVO, einhalten.<\/li><li>Die Verarbeitung personenbezogener Daten durch Parcandi wird in Parcandis Datenschutzerkl\u00e4rung n\u00e4her erl\u00e4utert, die [<a href=\"https:\/\/parcandi.info\/privacy-policy-de\/\" target=\"_blank\" rel=\"noopener\">hier<\/a>] abgerufen werden kann.<\/li><\/ol><\/li><li><strong>Haftungsbeschr\u00e4nkung<\/strong><ol><li>Vorbehaltlich der Regelung des \u00a7\u00a0599 BGB haftet Parcandi unbeschr\u00e4nkt f\u00fcr (a) die Verletzung des Lebens, des K\u00f6rpers oder der Gesundheit durch Parcandi, Parcandis gesetzliche Vertreter oder Erf\u00fcllungsgehilfen; (b) vors\u00e4tzlich oder grob fahrl\u00e4ssig verursachte Sch\u00e4den durch Parcandi, Parcandis gesetzliche Vertreter oder Erf\u00fcllungsgehilfen; (c) Sch\u00e4den aufgrund des Fehlens einer garantierten Beschaffenheit; und (d) Forderungen aus dem Produkthaftungsgesetz (ProdHaftG).<\/li><li>Vorbehaltlich der Regelung des \u00a7\u00a0599 BGB haftet Parcandi f\u00fcr Sch\u00e4den aus der Verletzung von Kardinalpflichten durch Parcandi, Parcandis gesetzliche Vertreter oder Erf\u00fcllungsgehilfen. Kardinalpflichten sind die Pflichten, deren Erf\u00fcllung die ordnungsgem\u00e4\u00dfe Durchf\u00fchrung des Nutzungsvertrages erst erm\u00f6glicht und auf deren Einhaltung der Nutzer regelm\u00e4\u00dfig vertraut und vertrauen darf. Sofern die Verletzung von Kardinalpflichten durch leichte Fahrl\u00e4ssigkeit von Parcandi, Parcandis gesetzlicher Vertreter oder Erf\u00fcllungsgehilfen erfolgt, ist die Haftung von Parcandi der H\u00f6he nach auf den Betrag begrenzt, der f\u00fcr Parcandi zum Zeitpunkt der Erbringung der jeweiligen Leistung vorhersehbar war.<\/li><li>Vorbehaltlich der Regelung des \u00a7\u00a0599 BGB sowie der Ziffern\u00a012.1 und\u00a012.2 haftet Parcandi nicht f\u00fcr Sch\u00e4den aus der Verletzung von Pflichten, die keine Kardinalpflichten darstellen und die leicht fahrl\u00e4ssig durch Parcandi, Parcandis gesetzlichen Vertreter oder Erf\u00fcllungsgehilfen verursacht wurden.<\/li><li>Der Nutzer erkennt an, dass die Nutzung der Stellpl\u00e4tze (inkl. etwaiger Zusatzleistungen) auf eigene Verantwortung und auf eigenes Risiko des Nutzers erfolgt. Fahrzeuge und Personen werden nicht bewacht.<\/li><li>Parcandi wird nicht Partei des Mietvertrages und haftet nicht f\u00fcr Anspr\u00fcche der Parteien des Mietvertrages, insbesondere nicht f\u00fcr Sch\u00e4den, die durch bzw. im Zusammenhang mit Fahrzeugen oder Parkobjekten verursacht werden oder f\u00fcr Diebstahl oder Sachbesch\u00e4digung durch Dritte sowie f\u00fcr Sch\u00e4den infolge von \u00e4u\u00dferen Einfl\u00fcssen (Feuer, Explosion, Wasser, Eis, Schnee usw.).<\/li><li>Eine \u00fcber die in dieser Ziffer 12 geregelten F\u00e4lle hinausgehende Haftung von Parcandi ist ausgeschlossen.<\/li><\/ol><\/li><li><strong>Einschr\u00e4nkung des Aufrechnungs- und Zur\u00fcckbehaltungsrechts | Abtretungsverbot<\/strong><ol><li>Der Nutzer kann gegen Forderungen von Parcandi nur aufrechnen, soweit seine Forderung rechtskr\u00e4ftig festgestellt oder von Parcandi unbestritten oder anerkannt ist.<\/li><li>Ist der Nutzer Verbraucher im Sinne von \u00a7\u00a013 BGB, so kann er ein Zur\u00fcckbehaltungsrecht nur geltend machen, soweit seine Forderung auf demselben Vertragsverh\u00e4ltnis beruht.<\/li><li>Ist der Nutzer Unternehmer im Sinne von \u00a7\u00a014 BGB, so kann er ein Zur\u00fcckbehaltungsrecht nur geltend machen, soweit seine Forderung auf demselben Vertragsverh\u00e4ltnis beruht, rechtskr\u00e4ftig festgestellt oder von Parcandi unbestritten oder anerkannt ist.<\/li><li>Ist der Nutzer Unternehmer im Sinne von \u00a7\u00a014 BGB, so ist er nur mit schriftlicher Zustimmung von Parcandi zur Abtretung von Forderungen von Nutzern aus dem Vertrag an Dritte berechtigt. \u00a7\u00a0354a HGB bleibt unber\u00fchrt.<\/li><\/ol><\/li><li><strong>Vollst\u00e4ndige Vereinbarung | Salvatorische Klausel | \u00c4nderungen | Aktualisierungen<\/strong><ol><li>Der Nutzungsvertrag einschlie\u00dflich dieser Nutzungsbedingungen stellt die vollst\u00e4ndige Vereinbarung zwischen dem Nutzer und Parcandi in Bezug auf seinen Vertragsgegenstand dar und ersetzt alle fr\u00fcheren schriftlichen oder m\u00fcndlichen Verhandlungen, Regelungen, Abreden, \u00dcbungen oder Vereinbarungen zwischen den Parteien in Bezug auf den Vertragsgegenstand und schlie\u00dft diese aus.<\/li><li>Sollte eine Regelung des Nutzungsvertrages einschlie\u00dflich dieser Nutzungsbedingungen, ganz oder teilweise unwirksam oder nichtig sein oder werden, so wird die Wirksamkeit der \u00fcbrigen Regelungen davon nicht ber\u00fchrt. An die Stelle der unwirksamen oder nichtigen Regelung tritt in diesem Fall eine Regelung, die dem am n\u00e4chsten kommt, was die Parteien nach dem Sinn und Zweck der urspr\u00fcnglichen Regelung und des Nutzungsvertrages in gesetzlich zul\u00e4ssiger Weise vereinbart h\u00e4tten, wenn sie die Unwirksamkeit oder Nichtigkeit der urspr\u00fcnglichen Regelung erkannt h\u00e4tten. Beruht die Unwirksamkeit oder Nichtigkeit einer Regelung auf einem darin festgelegten Ma\u00df der Leistung oder der Zeit (Frist oder Termin), so tritt an deren Stelle eine Regelung mit einem dem urspr\u00fcnglichen Umfang am n\u00e4chsten kommenden rechtlich zul\u00e4ssigen Umfang. Das Vorstehende gilt auch f\u00fcr eine etwaige von den Parteien nicht beabsichtigte Regelungsl\u00fccke in dem Nutzungsvertrag einschlie\u00dflich dieser Nutzungsbedingungen. Es ist der ausdr\u00fcckliche Wille der Parteien, dass diese salvatorische Klausel keine blo\u00dfe Beweislastumkehr zur Folge hat, sondern \u00a7\u00a0139 BGB insgesamt abbedungen ist.<\/li><li>\u00c4nderungen oder Erg\u00e4nzungen des Nutzungsvertrages m\u00fcssen schriftlich erfolgen (der Austausch einfacher E-Mails ist ausreichend). Dasselbe gilt f\u00fcr Vereinbarungen, von diesem Schriftformerfordernis abzuweichen oder auf dieses vollst\u00e4ndig zu verzichten. Ziffer\u00a014.4 bleibt unber\u00fchrt.<\/li><li>Parcandi kann diese Nutzungsbedingungen f\u00fcr laufende Nutzungsvertr\u00e4ge mit Wirkung f\u00fcr die Zukunft \u00e4ndern und\/oder aktualisieren, wenn dies aus technischen oder rechtlichen Gr\u00fcnden erforderlich ist. Jede \u00c4nderung dieser Nutzungsbedingungen wird dem Nutzer in Textform (eine einfache E-Mail ist ausreichend) mindestens sechs (6) Wochen vor ihrem beabsichtigten Inkrafttreten angek\u00fcndigt. Der Nutzer kann der \u00c4nderung vor dem Tag ihres beabsichtigten Inkrafttretens zustimmen oder widersprechen. Die \u00c4nderung gilt als von dem Nutzer angenommen, wenn der Nutzer der \u00c4nderung nicht vor dem Tag ihres beabsichtigten Inkrafttretens widerspricht. Im Falle eines rechtzeitigen Widerspruchs des Nutzers endet der Nutzungsvertrag im Zeitpunkt des beabsichtigten Inkrafttretens der \u00c4nderung dieser Nutzungsbedingungen.
